Wrongful Death Lawsuit Filed Against Houston Hospital

A Houston hospital and one of its physicians are at the center of a legal storm after the family of a young man who died in the hospital filed a wrongful death claim in early September.

According to the lawsuit, Baldomero Flores went to Doctors Hospital-Tidwell in December 2013 to seek treatment after battling a fever. The suit alleges that Flores was denied medical care for more than 40 minutes, as the hospital haggled with him over how he would pay for the emergency medical care.

Flores was originally transported via ambulance to Doctors Hospital-Tidwell after symptoms became progressively worse, further intensifying after arriving at the hospital. According to the medical examiner that performed the autopsy, Flores died as a result of anaphylactic shock that was caused by an allergic reaction to medication he had administered by another doctor for the fever earlier in the day.

Flores’ girlfriend, who was at the hospital on the day of his death, further alleges in the claim that medical staff did not rush to his aid, despite worsening symptoms. She also alleges that Flores did not receive necessary treatment – a critical shot of epinephrine – for more than an hour-and-a-half after arriving in the emergency room.

The CEO of the hospital recently told news outlets that the hospital was in the process of engaging a lawyer, while maintaining that the hospital provided Flores with the proper medical care. She also confirmed that the doctor named in the lawsuit is no longer employed at the hospital.
