Child Killed in Southwest Houston & Can I Pursue a Personal Injury Claim After a Hit-and-Run Crash

A hit-and-run accident is allegedly to blame for the loss of an 11-year-old Houston girl, who was killed in an incident on the city’s Southwest Freeway in late January.

According to Houston police, the accident occurred shortly after 6 pm on January 23, when an unidentified red vehicle struck the pickup truck transporting the victim and four others. The initial collision caused the pickup truck to slam into a concrete column near the intersection of the Southwest Freeway and Westpark Drive, but the driver of the red vehicle kept going.

Though the young girl was alive when emergency personnel reached the scene, police later indicated that she died while being treated at the hospital. Three other passengers were transported to area hospitals to be treated for their injuries, none of which were life threatening.

In cities like Houston, where drivers rely on increasingly busy roadways to travel on a daily basis, car accidents are not at all uncommon. Therefore, drivers must exercise additional caution when taking to the roads, or when finding themselves in an accident scenario.

Car Accidents in Houston

Car accidents continue to be a leading cause of personal injury in many cities across the country. Though many of these incidents are simply accidents – and impossible to prevent entirely – many car accident cases can also involve negligence, which can make a huge difference in personal injury cases.

In any car accident situation, it is critical that you remember three things: call the police right away; never admit liability; and gather as much information as possible – eyewitness names, pictures, written statements, etc. – which can later be used as evidence in the event of personal injury.

Unfortunately, many people involved in car accidents don’t even realize that they have been injured. The fact is, when adrenaline is pumping and your mind is flustered, you are not thinking about whether or not you have a serious injury. That’s why it’s so important that if you are involved in a car accident, you schedule an appointment with a doctor to receive the proper medical care.

Can I Pursue a Personal Injury Claim After a Hit and Run Accident in Texas?

At Charles J. Argento, our experienced car accident attorney in Houston understands the stress and anxiety that comes with getting hurt in a hit-and-run accident in Texas.

While our state laws require all drivers to stop and remain at the scene of an accident — even imposing additional criminal penalties for leaving a crash scene where someone was hurt — not all drivers are operating their vehicles legally.

In fact, the Insurance Information Institute reported over 8% of all Texas drivers are uninsured, which is a common reason drivers flee accident scenes throughout the state.

When Texas drivers leave the scene of a collision, it is often the result of underlying circumstances, including those who are driving under the influence of alcohol or drugs, driving without a valid driver’s license, and those who are texting while driving or already have a criminal warrant out for their arrest, which means causing a crash could send them to jail.

No matter the reason a driver did not stop at your accident scene, our Harris County personal injury attorney may be able to provide the legal solutions our clients need to pursue financial recovery using a different approach. Contact us today to learn more.

What Are My Legal Options for Hit-and-Run Accident Recovery in Texas?

There are few things that are as agonizing as being hit by a negligent driver, only to watch them pull away from the crash scene before you can record any of their vehicle details.

Unfortunately, when our Texas clients are injured in a hit-and-run accident, the fallout is overwhelming.

Who is going to pay for your medical care and lost wages? How can you afford to fix your vehicle?

There are several legal options available for hit-and-run car accident victims in Texas that our skilled personal injury lawyer in Houston can help with, including filing a claim with your car insurance provider.

Texas laws require all drivers to carry minimum liability coverage, where the limits are $30,000 for each injured person, $60,000 per accident, and $25,000 for property damage per accident.

In addition, insurance providers must ask all customers if they would like to add uninsured or underinsured coverage to their policy.

For those who have elected to add this important coverage to their car insurance policy, our skilled Houston car accident attorney can help you review your policy and negotiate on your behalf to get the most compensation possible for your injuries and property damage.
